Terms of Service

These Terms of Service ("Terms") govern use of the Yaard website, applications, marketplace, and related services (collectively, the "Services"). By creating an account, clicking acceptance, or using the Services, you agree to these Terms.
1. Platform only; independent providers
Yaard is a technology platform, not a lawn-care provider. Lawn-care businesses and crew members using Yaard are independent third parties, not Yaard employees, agents, partners, or joint venturers. Yaard does not perform or supervise lawn-care work, make employment decisions, guarantee provider licensing, insurance, availability, safety, quality, or results, or become a party to a service agreement between a homeowner and provider.
2. Eligibility and accounts
You must be at least 18 and able to enter a binding contract. You must provide accurate information, keep it current, protect your credentials, and promptly report suspected unauthorized access. You are responsible for activity under your account and for users you authorize to use it.
3. Homeowner responsibilities
Homeowners are responsible for accurate property, access, scheduling, and safety information; reviewing and accepting provider quotes and policies; and paying amounts properly due under an accepted quote, invoice, or checkout flow. Cancellation, rescheduling, refunds, workmanship, and service disputes are matters between the homeowner and provider, subject to any applicable law and the provider’s disclosed policy.
4. Business and crew responsibilities
Businesses are solely responsible for their services, pricing, estimates, permits, insurance, licensing, taxes, employment and contractor obligations, communications, customer data, marketing, reviews, and compliance with applicable law. Business users may access customer, employee, and business data only for authorized business purposes. Businesses must obtain all notices, consents, and permissions required to use personal data, send communications, and use location, photo, or other sensitive features through the Services.
5. Fees, billing, and payment disputes
Subscription prices, platform fees, marketplace commissions, service rates, and promotions may change for future periods as permitted by law. A service price is not binding until confirmed in an accepted quote, invoice, or checkout flow. Third-party payment processors may process payments. You authorize the applicable processor to charge amounts you approve and are responsible for valid payment information, chargebacks, and payment disputes arising from your acts or omissions, except where law requires otherwise.
6. Acceptable use and reviews
You may not violate law or third-party rights; submit fraudulent bookings, false or deceptive reviews, unlawful, abusive, discriminatory, or infringing content; interfere with platform security or performance; scrape, reverse engineer, or copy the Services except as law permits; or access data you are not authorized to access. Reviews must reflect an actual experience. Yaard may use reasonable processes to investigate, moderate, remove, or label content that appears fake, unlawful, unsafe, or inconsistent with these Terms, but is not required to review all content.
7. User content and intellectual property
You retain ownership of content you submit, but grant Yaard a non-exclusive, worldwide, royalty-free license to host, reproduce, display, adapt, and use it as needed to operate, secure, support, improve, and promote the Services. You represent that you have the rights needed to grant that license. Yaard and its licensors own the Services, software, branding, and platform content. Except for the limited right to use the Services under these Terms, no rights are granted.
8. Changes, suspension, and termination
We may modify, discontinue, or restrict features, content, and availability; suspend or terminate accounts; or remove content when we reasonably believe it is necessary to protect users, Yaard, or others, enforce these Terms, address risk or suspected fraud, or comply with law. You may stop using the Services at any time. Payment, ownership, disclaimers, limitations of liability, indemnity, and dispute provisions survive termination.
9. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, YAARD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. YAARD DOES NOT ENDORSE, GUARANTEE, OR WARRANT ANY USER, PROVIDER, SERVICE, REVIEW, QUOTE, PAYMENT, OR CONTENT.
10. Limitation of liability and release
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YAARD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, BUSINESS OPPORTUNITY, PERSONAL INJURY, PROPERTY DAMAGE, OR DISPUTES ARISING FROM A PROVIDER, CREW MEMBER, HOMEOWNER, OR THIRD-PARTY SERVICE. YAARD’S TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID YAARD IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR $100. TO THE EXTENT PERMITTED BY LAW, YOU RELEASE YAARD FROM CLAIMS ARISING from transactions or interactions between you and other users or providers. Some jurisdictions do not allow certain limitations, so these provisions apply only to the extent permitted by law.
11. Indemnification
You will defend, indemnify, and hold harmless Yaard and its officers, directors, employees, affiliates, and licensors from claims, damages, losses, liabilities, and expenses, including reasonable attorneys’ fees, arising out of your use of the Services, your content, your services or conduct as a provider or crew member, your violation of these Terms or law, or your infringement of another person’s rights.
12. Governing law and disputes
These Terms are governed by Texas law, without regard to conflict-of-law rules, except where federal or other mandatory law applies. Before filing a claim, you agree to contact us at support@yaard.online and try to resolve the dispute informally. Unless applicable law requires otherwise, exclusive venue for a dispute is the state or federal courts located in Dallas County, Texas, and you consent to their jurisdiction.
13. General terms
These Terms and any incorporated policies are the entire agreement concerning the Services. If a provision is unenforceable, the remainder remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; Yaard may assign them in connection with a merger, acquisition, financing, or sale of assets. We may update these Terms by posting a revised version and updating the “Last updated” date; continued use after the effective date is acceptance where permitted by law.
